moQuart Terms and Conditions. Last updated: October 18, 2026.

1. Who we are

These terms apply to your use of moquart.com and to anything you buy from us or send to us through it. The site is run by Amos Equipment Corp, doing business as moQuart ("moQuart", "we", "us"), 14547 ON-48, Whitchurch-Stouffville, Ontario L4A 3B5, Canada. By using the site or placing an order you agree to these terms. If you do not agree, please do not use the site.

2. Changes

We may change these terms at any time. Changes take effect when we post them on this page, and the "Last updated" date will change. An order is governed by the terms in force when it was placed.

3. Using the site

Use the site only for lawful purposes. Do not interfere with it, try to reach it without permission, copy its content by automated means or give us false information. We may suspend access at any time. The site's content, including text, logos and photos taken by us, belongs to moQuart or its licensors and may not be copied or reused without our written permission.

4. Listings and descriptions

Listings are based on information from owners, consignors, auctions, our records and our own inspection. We try to describe items accurately, but we do not guarantee that any description, photo, specification, year, hours, mileage, serial number, weight or size is complete or free of error. Photos are representative. Used equipment shows wear and may have been repaired, modified or fitted with non-original parts. Meter readings may not be verified. Please ask us questions, request more photos or videos and inspect the item before you buy. If a listing contains an error, or an item is no longer available, we may cancel the order and refund what you paid.

5. Used equipment is sold as is

Unless a listing or a written agreement with us says otherwise, every item is sold "as is, where is", with all faults. To the fullest extent the law allows, we give no warranty or condition of any kind, express or implied, including about condition, quality, merchantability, fitness for a purpose, road-worthiness, emissions, compliance with any standard, or that an item will work as intended. Any manufacturer's warranty is between you and the manufacturer.

6. Safety, inspection and compliance

You are responsible for inspecting the item, for having it inspected and certified where the law or a safety standard requires it (for example cranes, boom trucks, lifting gear, forklifts, pressure equipment and road vehicles), and for registering, insuring, maintaining and operating it lawfully and safely. We do not certify that any item meets the safety, emissions or other rules of the place where you will use it. Only trained and authorised people should operate heavy equipment.

7. Prices, taxes and payment

Prices are shown in Canadian dollars for Canada and in US dollars for other markets, and may change before we accept an order. They exclude freight, taxes, duties and fees unless the listing says otherwise. We charge sales taxes where the law requires, which in Canada includes GST/HST. Online checkout accepts the payment methods shown at checkout, which currently include Visa, Mastercard and American Express. Our payment processor handles card payments; we do not see or keep your full card number. For larger or international orders we may ask for payment by bank transfer and will send the details in writing. An order is accepted only when we confirm it. We may refuse or cancel any order, for example if payment cannot be verified, we suspect fraud or the sale could break the law, and we will refund what you paid for a cancelled order.

8. All sales are final

All sales are final. Returns and refunds are covered by our Refunds & Returns policy, which forms part of these terms.

9. Freight and delivery

A freight price shown at checkout is a quote for that order at the time you place it. It is based on the crated size and weight, the pickup location and the delivery address we hold. Sizes and weights are estimates until the item is packed, and we may revise the price if the real figures, the address or the service needed differ. Where no freight price is shown, we send a written quote on request, which holds only for the period stated in it. Delivery dates and transit times are estimates, not promises.

Carriers, forwarders, shipping lines and customs brokers are independent third parties. We are not responsible for their delays, damage, loss or errors, but we will help you with a claim. You are responsible for giving a correct, deliverable address, for being present with suitable unloading equipment, and for extra charges caused by a failed or delayed delivery, waiting time, storage or redelivery. We recommend that you insure the shipment.

10. Export, import and customs

Customs duties, import taxes, brokerage, permits, certifications and destination charges are your responsibility unless our written quote says they are included. You are responsible for making sure you may lawfully import and use the item in the destination country. We may refuse, cancel or delay any sale or shipment that we believe could break export controls, sanctions or other laws, and we are not liable for doing so. We may be required to share shipment details with customs and other authorities.

11. Title and risk

Title to an item passes to you when we have received payment in full. Risk of loss or damage passes to you when the carrier or your representative takes the item from our yard or other pickup location, including when we arrange the freight for you.

12. Selling or consigning equipment to us

Details, photos and requests you send through the Selling page or by email are an invitation to deal. They are not an offer for us to buy, and we are not obliged to buy, list, inspect or sell any equipment or to give a price. A purchase or consignment happens only under a written agreement signed by us. You confirm that you own the equipment or may offer it, that it is free of liens and that your information is accurate. You allow us to use your photos and descriptions to assess, advertise and sell the equipment. We keep submissions and photos for 90 days unless we make an agreement with you, and handle them as described in our Privacy Notice.

13. Limitation of liability

To the fullest extent the law allows:

  • moQuart is not liable for any indirect, incidental, special, consequential or punitive loss, or for lost profit, lost revenue, downtime, loss of use, loss of business or the cost of replacement equipment, however it arises and even if we were told it could happen.
  • Our total liability to you for any claim connected with an item, an order or the site is limited to the amount you paid us for that item, excluding freight, taxes and duties.
  • We are not liable for injury, loss or damage caused by the use, operation, transport, modification or repair of an item after risk has passed to you, or by events beyond our reasonable control such as carrier delays, port or border closures, strikes, weather, disasters, pandemics, war or government action.

Nothing in these terms limits liability that the law does not allow to be limited, including liability for fraud or for death or personal injury caused by our negligence, and nothing removes consumer rights that apply to you and cannot be given up.

14. Your responsibility to us

To the extent the law allows, you agree to compensate moQuart, its owners and staff for claims, losses and costs (including reasonable legal fees) arising from your breach of these terms, your unlawful use or export of an item, or the use of an item after risk has passed to you, except to the extent we caused the loss.

15. Privacy

We handle personal information as described in our Privacy Notice.

16. Governing law and disputes

These terms are governed by the laws of Ontario and the federal laws of Canada that apply there. The courts of Ontario have exclusive jurisdiction over any dispute, except where the law of your country gives you the right to bring a claim elsewhere. Before starting a claim, please contact us at admin@moquart.com so we can try to resolve it.

17. General

These terms and the Refunds & Returns policy are the whole agreement between us on their subject. If a part is found unenforceable, the rest stays in effect. Not enforcing a term is not a waiver of it. You may not transfer your rights under these terms without our written consent.
